RESOLUTION
ON THE APPROVAL OF REGULATIONS OF THE STATE DATA AGENCY (STATISTICS LITHUANIA)

Pursuant to item 9 of Article 22, Part 4 of Article 291 of the Law on the Government of the Republic of Lithuania and item 1 of Part 3 of Article 4 of the Law on Budgetary Institutions of the Republic of Lithuania, the Government of the Republic of Lithuania hereby r e s o l v e s the following:
1. To approve Regulations of the State Data Agency (attached).
2. To authorize the Director General of the State Data Agency to approve the structure of the State Data Agency's administration.
3. To recognize Resolution No 528 of 6 June 2018 of the Government of the Republic of Lithuania “On the approval of regulations of Statistics Lithuania and granting powers” with all amendments and supplements as having lost its power.
4. To establish that this Resolution shall enter into force on 1 January 2023.

REGULATIONS OF THE STATE DATA AGENCY (STATISTICS LITHUANIA)
CHAPTER I.
GENERAL PROVISIONS
1. The State Data Agency (hereinafter referred to as the "Agency") shall be an authority of the Government of the Republic of Lithuania.
2. The Agency shall be a budgetary institution, legal entity code 188600177 in the Register of Legal Entities, having a bank account and a seal bearing the national emblem of Lithuania and the name of the State Data Agency (Statistics Lithuania). The address of the head office of the Agency is: 29 Gedimino Ave., Vilnius.
3. The Agency shall be maintained from the State budget of the Republic of Lithuania and from other funding sources laid down by legislation.
4. The owner of the Agency shall be the State. The rights and duties of the owner of the Agency shall be executed by the Government of the Republic of Lithuania, which shall perform the functions established in the Law on Budgetary Institutions of the Republic of Lithuania.
5. Public information of the Agency shall be published on the website of the Agency (stat.gov.lt), official social communication internet websites and in other media laid down by legislation.
6. The Agency shall act in the fields of the management of official statistics and state data governance, assigned to the Minister of Finance.
7. The Regulations of the State Data Agency (hereinafter referred to as the “Regulations”) shall be amended under the resolution passed by the Government.
CHAPTER II.
OBJECTIVES AND FUNCTIONS OF THE AGENCY
8. The objectives of the Agency shall be:
8.1. to participate in the formation of and implementing state policy in the field of official statistics management;
8.2. to coordinate the production of official statistics in accordance with the provisions of Part I of the Official Statistics Programme;
8.3. to participate in the formation of and implementing state policy in the field of state data governance;
8.4. to coordinate the processing of state data according to the State Data Governance Programme.
9. For the purpose of fulfilling the objectives established in sub-item 8.1, the Agency shall perform the following functions:
9.1. performance of functions established in items 1, 2, 3, 5 of Part 2 of Article 5 of the Law on Official Statistics and State Data Governance of the Republic of Lithuania;
9.2. establishment of statistical observation forms and modes;
9.3. dissemination of statistical information to the users of official statistics, reflecting demographic, social and economic development trends and environmental changes in various forms and modes;
9.4. publication of statistical information on the Official Statistics Portal prepared under Part I of the Work Programme of Official Statistics;
9.5. provision of statistical information that is prepared not under Part I of the Work Programme of Official Statistics, if its preparation costs are defrayed by the users of official statistics;
9.6. introduction of new statistics-related international classifications, standards and methods in order to ensure preparation and dissemination of coherent and comparative statistical information; by order of the Government of the Republic of Lithuania, management of the Central Classification Database;
9.7. participation and making suggestions within the competence in the activity of the European Union and international statistical organisations on the improvement and development of the European Union and international statistics, contribution to the implementation of statistical programmes of international organisations and development of international statistics;
9.8. preparation of position of the Republic of Lithuania in the European Union institutions and their working groups or commissions on the subject in question in the field of official statistics, as well as submission of conclusions and proposals pertaining to positions in the field of official statistics of other institutions and establishments.
10. For the purpose of fulfilling the objective established in sub-item 8.2 hereof, the Agency shall perform the following functions:
10.1. performance of functions laid down in items 2, 4 of Part 2 of Article 5 of the Law on Official Statistics and State Data Governance of the Republic of Lithuania;
10.2. establishment of coordination and monitoring procedures of other institutions managing official statistics;
10.3. conclusion of agreements with other institutions managing official statistics pertaining to the organisation, quality assurance and dissemination of official statistics;
10.4. organisation of publication of statistical information and statistical indicators meta-information, prepared by other institutions managing official statistics, on the Official Statistics Portal;
10.5. coordination of the transmission of statistical data and (or) information, prepared by other institutions managing official statistics, to the Statistical Office of the European Union, international organisations;
10.6. coordination of the development and dissemination of statistical indicators that are necessary for the implementation of the Agenda of the United Nations Conference on Sustainable Development by 2030.
11. For the purpose of fulfilling the objective established in sub-item 8.3 hereof, the Agency shall perform the following functions:
11.1. performance of functions laid down in items 1, 5, 6, 8, 9, 10 of Part 2 of Article 5 of the Law on Official Statistics and State Data Governance of the Republic of Lithuania;
11.2. performance of works under the State Data Governance Programme;
11.3. publication of statistical information on the Official Statistics Portal prepared on the basis of state data;
11.4. participation and making suggestions within the competence to the drafter of the position of the Republic of Lithuania in the European Union institutions and their working groups or commissions in the field of state data governance, as well as submission of conclusions and proposals to state institutions and establishments pertaining to their positions in the field of state data governance.
11.5. processing, analysis of state data in the implementation of goals and tasks important to the State;
11.6. provision of state data necessary to achieve the goals set in Part 1 of Article 21 of the Law on Official Statistics and State Data Governance of the Republic of Lithuania to state data users through the State Data Governance information system.
12. For the purpose of fulfilling the objective established in in sub-item 8.4 hereof, the Agency shall perform the following functions:
12.1. performance of functions laid down in item 7 of Part 2 of Article 5 of the Law on Official Statistics and State Data Governance of the Republic of Lithuania;
12.2. submission of proposals to state and municipal authorities and agencies, companies, organizations and other legal entities pertaining to state data management, processing and use, and cooperation with them;
12.3. establishment of a public state data metadata catalogue intended to meet the needs of state data users in order to achieve the objectives specified in Part 1 of Article 21 of the Law on Official Statistics and State Data Governance of the Republic of Lithuania;
12.4. supervision of the use of the State Data Management Platform, production of recommendations and decision-making regarding the efficient use of its resources.
13. The Agency shall also perform the following functions with regard to its operational objectives:
13.1. performance of functions laid down in items 11, 12, 12 of Part 2 of Article 5 of the Law on Official Statistics and State Data Governance of the Republic of Lithuania;
13.2. submission of proposals pertaining to draft legal acts on official statistics, provision of conclusions to other institutions or establishments on having an effect on the quality of such drafts and legal regulation in the field of official statistics;
13.3. consideration of letters, inquiries, proposals, applications, complaints received by the Agency from State and municipal authorities and agencies, other legal or natural persons;
13.4. initiation of administrative proceedings, conduct of administrative investigations, drawing up protocols of administrative offences, processing cases of administrative offences within the competence of the Agency;
13.5. performance of functions assigned to the institution authorized by the Government in Part 3 of Article 15 of the Law on the Right to Receive Information and Reuse of Data of the Republic of Lithuania;
13.6. performance of functions assigned to the institution authorized by the Government in Articles 3–7, 9–11, 13, 16, 17 of the Law on Reuse of Health Data of the Republic of Lithuania;
13.7. implementation of organisational and technical measures ensuring protection and confidentiality of statistical data and statistical information;
13.8. implementation of organisational and technical measures ensuring state data protection.
CHAPTER III.
RIGHTS OF THE AGENCY
14. Pursuing the objectives and for the purpose of performing its functions, the Agency shall have the following rights:
14.1. rights laid down in Part 3 of Article 5 and Article 10 of the Law on Official Statistics and State Data Governance of the Republic of Lithuania;
14.2. to receive information on the works planned, which are required for the preparation of the State Data Governance Programme, from State and municipal authorities and agencies, enterprises, organisations and other legal persons;
14.3. if needed, to invite experts, to provide expert assistance in the field of implementation, development and improvement of official statistics and state data governance;
14.4. to cooperate with State and municipal authorities and agencies in performing works related to official statistics and state data governance under contracts;
14.5. to invite representatives and experts from other State and municipal authorities and agencies, non-state organisations, state enterprises for the consideration of issues to be solved by the Agency, and to form special commissions and working groups;
14.6. to receive statistical information and metadata from other institutions managing official statistics and to disseminate it on the Official Statistics Portal;
14.7. to organise and carry out general censuses; to involve, for that purpose, interviewers, State and municipal authorities and agencies, if needed, in accordance with the procedure laid down by the Government of the Republic of Lithuania;
14.8. to check how other institutions managing official statistics comply with the principles of the European Statistics Code of Practice and other legal acts regulating official statistics;
14.9. to provide statistical data for scientific purposes to higher education schools or scientific research institutions on a contract basis under the procedure laid down by the Director General of the Agency;
14.10. to conclude mutual agreements with the Bank of Lithuania on the implementation of the Official Statistics Programme and statistical investigations of the European Statistical Programme carried out by the Bank of Lithuania;
14.11. to carry out experimental (not included into Part I of the Work Programme of Official Statistics, to be performed by applying new statistical data-processing methods, pilot) statistical studies;
14.12. to receive metadata of state information resources from State and municipal authorities and agencies, companies, organizations and other legal entities, to provide technical and methodological assistance in their preparation;
14.13. to determine the methods of providing state data.
15. The Agency may have other rights laid down by legislation, related to its objectives and functions.
CHAPTER IV.
ORGANISATION OF ACTIVITY OF THE AGENCY
16. The activities of the Agency shall be organized in accordance with the strategic activity plan prepared in accordance with the procedure established by the Government of the Republic of Lithuania, which is approved by the Minister of Finance of the Republic of Lithuania, and the annual activity plan, which is approved by the Director General of the Agency, in coordination with the Minister of Finance of the Republic of Lithuania. Strategic and annual activity plans are implemented and monitoring of their implementation, evaluation of results and reporting on the results obtained shall be performed under the procedure laid down in the Law on Strategic Management of the Republic of Lithuania.
17. The Agency shall be headed by the Director General, who shall be appointed to and dismissed from office under the procedure laid down in the Law on Civil Service of the Republic of Lithuania.
18. The Director General of the Agency shall approve the structure of the administration of Statistics Lithuania.
19. In the temporary absence of the Director General of the Agency, the Director General shall be deputised for by the First Deputy Director General, in the absence thereof – another Deputy Director General by the order of the Director General.
20. The Director General shall supervise the administrative divisions of the Agency directly or through deputies. Deputies of the Director General shall be directly subordinate and accountable to the Director General. Deputies of the Director General shall organise and control the work of the heads of the administrative divisions supervised by them, coordinate the activity of those divisions, perform other functions delegated by the Director General.
21. The Director General of the Agency shall:
21.1. perform functions laid down in Part 2 of Article 6 of the Law on Official Statistics and State Data Governance of the Republic of Lithuania;
21.2. ensure the achievement of the operational objectives set for the Agency and the performance of functions;
21.3. monitor the implementation of legal acts regulating official statistics and state data governance;
21.4. organise and coordinate the implementation of the assignments of the Government and the Prime Minister of the Republic of Lithuania;
21.5. issue orders, decisions and perform supervision of the implementation thereof;
21.6. under the procedure laid down by the Government of the Republic of Lithuania be held accountable for the activity of the Agency, submit reports on his/her activity at the request of the Government or the Minister of Finance of the Republic of Lithuania;
21.7. identify respective areas to be mentored (supervised) by Deputies of the Director General;
21.8. organise rational and cost-effective use of the funds and property of the Agency, effective creation, development, functioning and improvement of the internal control system of the Agency.
22. In accordance with the procedure laid down in Article 7 of the Law on Official Statistics and State Data Governance of the Republic of Lithuania an advisory body of the State Data Agency – the Statistical Council – may be established in the Agency.
23. In accordance with the procedure laid down in Article 8 of the Law on Official Statistics and State Data Governance of the Republic of Lithuania an advisory body of the State Data Agency – the State Data Governance Council – may be established in the Agency.
24. The internal audit of the Agency shall be performed by the Centralised Internal Audit Service of the Ministry of Finance of the Republic of Lithuania.
CHAPTER V.
FINAL PROVISIONS
25. The Agency may be reorganised, liquidated or restructured in accordance with the procedure laid down by the Civil Code of the Republic of Lithuania, the Law on the Government of the Republic of Lithuania and the Law on Budgetary Institutions of the Republic of Lithuania.
